These Terms of Service ("Terms") govern your use of NinjaOtter ("we," "our," or "us"), the AI receptionist platform operated at ninjaotter.io. By creating an account or using our service, you agree to these Terms.
You must be at least 18 years old and authorized to operate on behalf of the business you register. By signing up, you represent that you have the authority to bind your business to these Terms.
You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
You must provide accurate and complete information during registration and keep it up to date.
NinjaOtter provides an AI-powered receptionist that automatically responds to customer communications (phone calls, text messages, emails, social media messages, and website chat) on behalf of your business.

Plans: We offer monthly subscription plans (Starter, Pro, Business) at the prices listed on our website. Prices may change with 30 days notice.
Free Trial: New accounts receive a 5-day free trial. Your payment method will be charged at the end of the trial unless you cancel before it expires.
Billing: Subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
Cancellation: You may cancel your subscription at any time through the Account page or Stripe customer portal. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused time.
Refunds: We do not offer refunds. The free trial is your opportunity to evaluate the service before committing. If you experience a technical issue that prevents you from using the service, contact us and we will work to resolve it.
Overage Charges: Pro plan users who exceed 200 included call minutes per month will be billed at $0.18 per additional minute at the end of the billing cycle.

You retain ownership of all business information and content you provide to NinjaOtter. By using our service, you grant us a license to use this content solely to operate the service on your behalf.
You are responsible for ensuring you have the right to share any content, credentials, or customer data with our platform. You must comply with all applicable privacy laws regarding your customers' data.
NinjaOtter integrates with third-party services including Twilio, Meta (Facebook/Instagram), Stripe, Vapi, and AI providers. Your use of these integrations is also subject to their respective terms of service. We are not responsible for outages, changes, or issues caused by third-party providers.
The NinjaOtter platform, including its design, code, AI models, branding, and documentation, is our intellectual property. You may not copy, modify, distribute, sell, or reverse-engineer any part of the service.
The NinjaOtter name, logo, and mascot are our trademarks. You may not use them without our written permission.
To the maximum extent permitted by law, NinjaOtter and its operators shall not be liable for:
Our total liability for any claim related to the service shall not exceed the amount you paid us in the 3 months preceding the claim.
You agree to indemnify and hold harmless NinjaOtter and its operators from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
We may modify, update, or discontinue features of the service at any time. We will make reasonable efforts to notify you of significant changes. Continued use of the service after changes constitutes acceptance of those changes.
You may terminate your account at any time by cancelling your subscription and contacting us to delete your data.
We may terminate or suspend your account at any time for violation of these Terms, non-payment, or any other reason at our discretion. Upon termination, your right to use the service ceases immediately.
Any disputes arising from these Terms or the service shall be resolved through good-faith negotiation first. If unresolved, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state of Texas.
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NinjaOtter regarding the use of our service.
